 Although I believe that we understand this to be for greater outlawry (life) and not lesser outlwary(a few years). These are distinct states. Then former is a 'nithing' who has been rejected by society, the latter is serving a sentence (to preserve the peace).
 
 So, to be clear, I think the question is as to whether a 'nithing' is still kin.
